Welcome to Dearlark, operated by Pomelo Next LLC. By using dearlark.com or placing an order, you agree to these Terms. Please also read our Privacy Policy, Return & Refund Policy, and Personalization Terms, which are part of these Terms.

1. Who we are

Dearlark is a brand of Pomelo Next LLC, organized in the State of Wyoming. Contact: sales@dearlark.com.

2. Orders

All orders are subject to acceptance. We may refuse or cancel an order — for example if an item is mispriced, unavailable, or the order violates these Terms or our Personalization Terms — and we’ll refund any payment for a cancelled order.
Prices are in U.S. dollars and may change at any time, but changes won’t affect orders already placed.
Products are made to order and personalized; see our Return & Refund Policy for what that means for returns.

3. Personalization content

When you upload a photo or add text, you make the promises set out in our Personalization Terms (including that you have the right to use the content). We may decline or refund any order whose content violates those terms.

4. Intellectual property

The Site, our brand, logos, text, and designs are owned by Pomelo Next LLC or our licensors and are protected by law. You may not copy or use them without permission. You keep ownership of the photo you upload; you grant us the limited license described in the Personalization Terms so we can make your product.

5. Acceptable use

Don’t misuse the Site: no unlawful activity, no infringing or harmful content, no attempts to disrupt or gain unauthorized access, and no uploading content you don’t have the right to use.

6. Pricing and payment

Payment is processed securely through our payment processor at checkout. You confirm you’re authorized to use the payment method.

7. Disclaimers

The Site and products are provided “as is” to the fullest extent allowed by law. We don’t guarantee the Site will always be error-free or uninterrupted. Screen colors may vary from printed results, and all-over-print placement varies slightly between items; this is normal.

8. Limitation of liability

To the fullest extent permitted by law, Pomelo Next LLC won’t be liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid for the order at issue.

9. Indemnity

You agree to indemnify Pomelo Next LLC against claims arising from content you upload or your misuse of the Site, as described more fully in the Personalization Terms.
